Injury at VA Treated Like "Service Connected" Injury

Pursuant to Title 38 U.S.C. Section 1151, the VA may compensate a Veteran for death or disability "as if service-connected" from injuries caused by or as the result of VA hospitalization. To be eligible you must be a Veteran and must have a disabling condition which is the result of or aggravated by VA sponsored medical treatment. There must be evidence that the condition is the 1) direct result of the VA's carelessness, negligence, lack of proper skill, or error in judgment; or 2) not a reasonably expected result or complication of the type of care received; or 3) the direct result of participation in a Vocational Rehabilitation and Employment program.
